1) AGREEMENT<\/strong>
\nBy using this site or our cloud-based software, you agree to respect and work under the following terms.<\/p>\n

2) WEBSITE CONTENT USAGE<\/strong>
\nLogo, brand images, or any kind of artwork is protected under Swiss copyright law and shall not be used without the written consent of BlueCallom AG. You are free to share any part of the content or announcements as long as you do not use it for commercial usage and you do make proper attribution, by mentioning our name \u201cBlueCallom\u201d or \u201cBlueCallom AG\u201d, not using any other abbreviation,\u00a0 and using the link to https:\/\/bluecallomaiacademy.com\/.<\/p>\n

3) YOUR PERSONAL DATA<\/strong>
\nWhen using our site without registering, you may be asked to allow us to store cookies, but we do not store any personal information. When you register as a customer, or sending us messages through the various online forms, your data including personal data such as your name and email address will be stored in our system for communication purposes.<\/p>\n

4) APPLICATION SOFTWARE CONTENT<\/strong>
\nContent you create in the BlueCallom Application (BlueCallom.AI) remains your content and you have all the rights to it. Content that you store in the BlueCallom Application Software, is encrypted and BlueCallom employees have no access to that content, unless you create an account for them to provide any type of support services. Content that you share with other systems through the BlueCallom APIs is bound to the rights and terms of the systems you are using. You have the right and the option to disable any API access for all users of your account.<\/p>\n

As a customer, you agree that we are using parts of your non-personalized data to build up industry metadata for peer group comparisons without ever using or referencing your brand, any personal data, or any innovation-related content that you crefted. All\u00a0Innovation-related\u00a0<\/strong>content such as innovation names, descriptions, ideas, feedback, research, and whatever else you entered into the application is considered confidential and highly encrypted in the database. All connections between the software and the web are encrypted as well. You have the right to access, download or delete your data at any time. Should you allow specific users to export data, you will be responsible for protecting the export function.<\/p>\n

5) NON DISCLOSURE AGREEMENT<\/strong>
\nAs a user of our site or our cloud-based software, you will never disclose any confidential information to any BlueCallom employee or representative in any way or shape, unless you entered into a specific agreement that would make such exchange necessary. No BlueCallom employee or representative is given any access keys to decrypt your data.<\/p>\n

6) DISCLAIMER<\/strong>
\nAny type of content on our website, our innovation application, or other digital or physical properties is provided as-is with no entitlement to be accurate. Content may come from many sources and are not exclusively created by BlueCallom. BlueCallom does not take any responsibility for the quality of the content, including potentially unwanted injected viruses or other damage in any way or shape.<\/p>\n

7) FEES<\/strong>
\nAccess to and use of our website is free of charge. Use of our Agentic AI Enterprise Workflow Intelligence Solutions<\/strong> is subject to fees. All pricing details can be found here.<\/a><\/p>\n

9) DISPUTE
\n<\/strong>THE PARTIES HERETO AGREE THAT ANY AND ALL DISPUTES ARISING OUT OF THE TERMS OF THIS AGREEMENT, THEIR INTERPRETATION, AND ANY OF THE MATTERS HEREIN RELEASED SHALL BE SUBJECT TO BINDING ARBITRATION IN SWITZERLAND. THE PARTIES AGREE THAT THE PREVAILING PARTY IN ANY ARBITRATION SHALL BE ENTITLED TO INJUNCTIVE RELIEF IN ANY COURT OF COMPETENT JURISDICTION TO ENFORCE THE ARBITRATION AWARD. THE PARTIES AGREE THAT THE PREVAILING PARTY IN ANY ARBITRATION SHALL BE AWARDED ITS REASONABLE ATTORNEY FEES AND COSTS TO THE EXTENT PROVIDED BY LAW. PARTNER EXPRESSLY ACKNOWLEDGES THAT IT IS WAIVING ANY RIGHT TO A JURY TRIAL FOR ANY AND ALL CLAIMS COVERED BY THE AGREEMENT.<\/p>\n

10) GOVERNING LAW
\n<\/strong>This agreement and any questions which may arise under this Agreement, without regard to conflict of law principles, is governed by the Swiss law.<\/p>\n

11) ENTIRE AGREEMENT
\n<\/strong>This AGREEMENT contains the final, complete, and exclusive agreement of the parties with respect to the subject matter hereof and supersedes all previous verbal and written agreements.\u00a0 This Agreement cannot be amended, in whole or in part, without a written instrument signed by both of the parties hereto.<\/p>\n

12) POLICY UPDATES<\/strong>
\nRegistered users of BlueCallom.AI will be notified of any changes in our privacy policy<\/a>\u00a0or terms automatically. Notification is sent to the email address you provided in your profile.<\/p>\n
